L-1 Intracompany Transferee
The L-1 is a non-immigrant visa that lets a multinational company transfer a qualifying executive or manager (L-1A) or an employee with specialized knowledge (L-1B) from a foreign office to a related U.S. office.
Non-immigrant (L-1A / L-1B)
Related U.S. employer (petition on Form I-129)
Not directly; L-1A managers and executives may qualify for the EB-1C route
At least one continuous year abroad with the qualifying company in the last three years
Multinational companies and entrepreneurs expanding to the U.S.
The foreign and U.S. entities must be parent, subsidiary, branch, or affiliate.
The employee has worked for the foreign entity for one continuous year within the three years before the transfer.
Executive or managerial capacity (L-1A) or specialized knowledge (L-1B), in the U.S. and abroad.
For a new U.S. office, evidence of premises, funding, and a plan to support a managerial or executive position within one year.
Confirm the qualifying corporate relationship, the role category, and the employee's year of employment abroad.
The U.S. employer files Form I-129 with USCIS (or uses a blanket L petition where available).
USCIS issues the approval notice used to apply for the visa.
File the DS-160 and attend the consular interview, where required for the applicant's nationality.
The employee is admitted in L-1 status; initial stays are generally up to three years (one year for new offices).
