EB-5 Immigrant Investor Program
The EB-5 Program grants lawful permanent residency to foreign investors who invest USD 1,050,000 (standard) or USD 800,000 (in a Targeted Employment Area, TEA) in a commercial enterprise that creates 10 full-time U.S. jobs.
Immigrant (employment-based, fifth preference)
None: investor petition
USD 1,050,000 standard; USD 800,000 in a TEA
10 full-time U.S. jobs
Yes: conditional for 2 years, then unconditional
The investor must document that the investment capital was obtained lawfully, through a full source-of-funds and path-of-funds audit.
Funds must be genuinely invested and placed at risk for the purpose of generating a return.
The enterprise must create or preserve 10 full-time jobs for qualifying U.S. workers.
The investor either manages the new enterprise directly or invests through a regional center project.
Select the project and compile the lawful source-of-funds and path-of-funds evidence before investing.
File Form I-526E (regional center investments; direct investments use Form I-526) with USCIS.
After approval, the investor obtains an immigrant visa or adjusts status and receives a two-year conditional green card.
Within the 90-day window before the second anniversary, file Form I-829 to show the investment was sustained and the jobs were created.
On approval of Form I-829, conditions are removed and the investor holds unconditional permanent residence.
