EB-2 National Interest Waiver (NIW)
The EB-2 National Interest Waiver (NIW) is an elite employment-based immigrant visa that allows high-caliber professionals and researchers to waive the PERM labor certification and self-petition without employer sponsorship, under the Matter of Dhanasar standard.
Immigrant (employment-based, second preference)
None: self-petition
Yes: permanent residence
Satisfy all three Dhanasar prongs
Researchers, specialists, and founders with a proposed endeavor of national importance
The applicant must qualify for EB-2 on the basis of an advanced degree or exceptional ability (see 5.2).
The proposed endeavor has substantial merit and national importance.
The applicant's education, skills, record of success, and plans show they are well positioned to advance it.
On balance, it would be beneficial to the United States to waive the job-offer and labor-certification requirements.
Define the proposed endeavor clearly: what the applicant will do, why it matters nationally, and the plan to advance it.
Assemble evidence mapped to each prong: expert recommendation letters, publications, citations, projects, and impact documentation.
File Form I-140 as a self-petitioner, with the option of USCIS Premium Processing for a faster decision (confirm the current premium timeframe before publishing).
Check whether the priority date is current. Applicants from oversubscribed countries may wait for a visa number.
Complete adjustment of status (I-485) in the U.S. or consular processing abroad; the green card is issued on approval.
