E-2 Treaty Investor Visa
The E-2 is a premier non-immigrant visa that allows nationals of designated treaty countries to enter, live, and operate a business in the U.S. by making a substantial financial investment. The visa can generally be renewed for as long as the enterprise continues to qualify. It is a temporary status and does not by itself lead to a green card. Eligible family members may accompany the investor.
Non-immigrant (E-2)
No employer sponsor: the investor's own U.S. enterprise
Not directly; renewable while the enterprise qualifies
Substantial capital at risk in a real, active U.S. business
Entrepreneurs who are nationals of a treaty country
The investor holds the nationality of a country with an E-2 treaty with the U.S. (the enterprise must be at least 50% owned by nationals of that country).
Funds are committed and irrevocably at risk, and are substantial relative to the total cost of the business. There is no fixed statutory minimum.
A genuinely operating business, not a passive or speculative investment.
The business must generate more than a minimal living for the investor and family, or have a significant economic impact, including U.S. job creation.
The investor will develop and direct the enterprise (or is an executive, supervisor, or essential-skills employee of it).
Confirm treaty nationality, form or acquire the U.S. entity, and commit investment funds at risk (lease, equipment, inventory, purchase agreement). Source-of-funds documentation is compiled.
Prepare a detailed plan with market analysis, financial projections, and hiring forecasts that demonstrate a non-marginal enterprise.
Complete the online DS-160 and treaty trader/investor application, and assemble the evidence binder: ownership, investment proof, plan, registrations.
Attend the interview at the designated U.S. embassy or consulate, supported by interview coaching on the investment, business model, and executive role.
Travel to the U.S., seek admission in E-2 status, and launch operations while maintaining compliance for future renewals.
